The court date has been moved from Sept. 18, 2006 to February 5, 2007.

Subject: Update Email Message
On May 30, 2006, the 73rd Judicial District Court of Bexar County, Texas, issued a Temporary Injunction against BioPerformance, Inc. The original trial date was set for September 18, 2006. The trial date has now been moved to February 5, 2007. We are working diligently to move this case through the legal system. Product testing is an important part of this process. We miss communicating with you on a regular basis, but we must operate within the guidelines set by our legal counsel.
